Itinerova Terms of Service
These Terms of Service ("Terms") are an agreement between you and ITINEROVA LLC, a Puerto Rico limited liability company (PR Department of State Register No. 592104) ("Itinerova," "we," "us"). They cover the Itinerova website at itinerova.com, our web app, any mobile app, and related services (together, the "Service").
1. What Itinerova is (and isn't)
Itinerova is a tool for planning trips and organizing itineraries. Itineraries, suggestions, briefings and AI-generated content are suggestions only.
We are not a travel agent, tour operator, carrier, or booking agent. We don't book, sell, or guarantee any flight, lodging, tour, transport, restaurant, or other travel service. Buying flight tickets in Itinerova isn't available yet (coming later). You can still add flights you already booked elsewhere and turn on flight status alerts.
Third-party providers are responsible for their services. We are not responsible for the acts, omissions, prices, availability, schedules, cancellations, or policies of airlines, hotels, tour operators, or any other third party, even if we show their information or link to them.
Prices, hours, schedules and availability can change and may be out of date or wrong in the Service.
You are responsible for your travel. Verify all important information directly with the provider and official sources before you rely on it, including entry, visa, passport, health and vaccination requirements, local laws, and safety conditions (for example, official government travel advisories).
2. Eligibility and accounts
You must be at least 16 years old (or older if your country requires it) to create an account. The Service is not directed to children.
Give accurate information, keep your password secure, and tell us promptly at support@itinerova.com if you think your account was accessed without permission.
You're responsible for activity under your account. One person per account unless we offer a team plan.
3. AI features
Some features use artificial intelligence provided by third-party model providers (currently OpenAI and Anthropic).
AI output can be inaccurate, incomplete, or out of date, and may describe places, times, or facts that are wrong or don't exist. Review it before relying on it.
Content you submit to AI features (prompts, itinerary content, and voice/audio when you use voice features) is sent to these providers to generate a response, as described in our Privacy Policy.
We log AI usage per account (for example, number of requests and voice minutes) for billing, fair use, and abuse prevention.
Don't use AI features to generate unlawful or harmful content (see the Acceptable Use Policy).
4. Voice features
Voice input and spoken briefings use your device microphone only when you turn them on. We'll show a notice before your first use. Each live voice session ends automatically after a maximum length (15 minutes on Pro, 5 minutes on Free), and voice use counts toward the limits in the Acceptable Use & Fair Use Policy. See the Privacy Policy for how audio and transcripts are handled.
5. Plans, billing and renewal
Free plan. Available at no cost, with the limits in the Acceptable Use & Fair Use Policy. These limits may change.
Pro plan. USD $16.99 per month or USD $49 per year. In the European Union, Pro costs €16.99 per month or €49 per year; in the United Kingdom, £14.99 per month or £44.99 per year. EU and UK prices include VAT. The price for your location is shown on our pricing page and at checkout. There is no free trial.
Automatic renewal. Pro renews automatically at the end of each monthly or annual period at the then-current price until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method for each renewal.
Taxes.
United States and Puerto Rico: prices are shown before tax. Applicable taxes, such as Puerto Rico sales and use tax (IVU), will be added where required and shown separately at checkout.
EU and UK consumers: the price shown includes VAT at the rate for your country, and the VAT amount is shown at checkout before you pay.
EU and UK business customers: if you enter a valid VAT ID at checkout, we charge no VAT under the reverse-charge mechanism, and you account for VAT in your country. We may verify your VAT ID; if it isn't valid, VAT applies.
Other countries: prices shown include applicable VAT, GST or similar taxes where we're required to collect them. Where we aren't required to collect them (for example, in Switzerland today), we don't add them.
Your tax location is based on the billing address and other information you give at checkout. Please keep it accurate.
Tax charged by mistake is refunded to you, as described in the Refund & Cancellation Policy. We don't keep tax we shouldn't have charged.
Upgrades (for example, Free to Pro, or monthly to annual) take effect immediately; any price difference is prorated and charged at that time.
Downgrades and cancellations take effect at the end of the current billing period. You keep Pro access until then. We don't refund partial periods except as stated in the Refund & Cancellation Policy.
Refunds. New annual purchases and annual renewals can be refunded in full within 14 days of the charge. Monthly charges aren't refunded, except for billing errors, tax charged by mistake, and the EU/UK right of withdrawal. Details are in the Refund & Cancellation Policy.
EU/UK right of withdrawal. If you're a consumer in the EU or the UK, you have a 14-day right to withdraw. At checkout we ask you to request that Pro start immediately. If you withdraw within 14 days, we refund your latest payment in full. You can withdraw in Settings → Plan & billing → Withdraw from contract. See the Refund & Cancellation Policy.
How to cancel. Anytime, online, in Settings → Plan & billing → Manage billing (Stripe Customer Portal). You can also email support@itinerova.com.
Failed payments. If a renewal payment fails, your subscription becomes past due. You keep Pro access for a grace period of 3 days; if payment isn't resolved by then, your account moves to the Free plan. Your content is not deleted because of a downgrade, but Pro-only features stop working.
Price changes. We'll give you at least 30 days' notice by email before a price change applies to your subscription. The new price applies starting with your next renewal after the notice period; you can cancel before then.
Payment processing. Payments are handled by Stripe, Inc. We don't receive or store your full card number. Stripe's terms and privacy policy also apply to your payment.
Where to buy. Pro is sold on our website only. Mobile apps from app stores don't sell subscriptions.
Courtesy Pro. We may, at our discretion, grant free ("courtesy") Pro access to some accounts. Courtesy Pro can be changed or ended at any time and doesn't renew into a paid plan without your agreement.
Promotional codes are subject to any terms shown with them and have no cash value.
6. Fair use
Pro includes generous use of AI and voice features, subject to the fair-use limits in the Acceptable Use & Fair Use Policy. Today that means about 120 live-voice minutes per month (up to 15 minutes per session), 3 spoken briefings per day and 50 per month, and 50 receipt scans per month. The Free plan has lower limits, for example 5 voice minutes per day and 30 per month. We may adjust these limits with notice, as described in that policy.
7. Your content
You own the content you add (trips, notes, files, photos, prompts, etc.).
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your content only to operate, secure, and improve the Service for you, including sending it to our service providers (such as AI providers) as described in the Privacy Policy. This license ends when your content is deleted from the Service, except for backups kept for a limited time and anything you shared with others.
You're responsible for having the rights to what you upload or share, including other people's personal information (for example, travel companions) and photos of other people.
If you share a trip with others, they can see and, depending on permissions, edit what you share.
Files and photos you upload, including outfit photos, are private to you by default. Other people on a shared trip don't see them unless you choose to share them.
8. Acceptable use
You must follow our Acceptable Use & Fair Use Policy. We may remove content or suspend accounts that violate it.
9. Our property
The Service, including its software, design, and branding, belongs to Itinerova and its licensors. We give you a limited, personal, non-transferable right to use the Service under these Terms. Don't copy, resell, or reverse engineer it, except where the law allows. If you send us feedback, we can use it without obligation to you.
10. Third-party services
The Service connects to or displays third-party services (for example, maps, sign-in providers, email, and payment). Your use of those services is also governed by their terms. We're not responsible for third-party services.
11. Changes to the Service and these Terms
We may change or discontinue features. We may update these Terms; if a change is material, we'll notify you by email or in the app at least 30 days before it takes effect (unless the change is required by law or for security, in which case it may take effect sooner). If you keep using the Service after the effective date, the new Terms apply. If you don't agree, cancel and stop using the Service before then.
12. Ending your account
You can stop using the Service and delete your account at any time in Settings → Account → Delete account. Deleting your account cancels your subscription, but doesn't automatically refund any paid period.
We may suspend or end your access if you seriously or repeatedly breach these Terms, if required by law, or to protect the Service or other users. When reasonable, we'll give notice and a chance to fix the problem. If we end your paid plan without cause, we'll refund the unused part of your prepaid period.
Sections that by their nature should survive (for example, 7 (license for backups), 9, 13, 14, 15, 16) survive.
13. Disclaimers
TO THE EXTENT ALLOWED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ITINERARIES, AI OUTPUT, OR THIRD-PARTY INFORMATION WILL BE ACCURATE OR SAFE. TRAVEL DECISIONS ARE YOURS.
14. Limitation of liability
TO THE EXTENT ALLOWED BY LAW: (A) ITINEROVA WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED TRAVEL, OR COSTS OF TRAVEL SERVICES; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.
These limits don't apply where the law doesn't allow them (for example, for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence), and they don't limit rights you have as a consumer that can't be waived.
15. Indemnity
If you use the Service in breach of these Terms or the law and that causes a third-party claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent allowed by law. This doesn't apply to consumers in places where such clauses aren't enforceable.
16. Governing law and disputes
Contact us first. Most problems can be solved by email. Please write to support@itinerova.com and give us 30 days to try to resolve it.
Governing law. These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-law rules.
Venue. Disputes will be resolved in the courts located in San Juan, Puerto Rico (the Court of First Instance, San Juan Judicial Region, or the U.S. District Court for the District of Puerto Rico), and you and we consent to their jurisdiction.
Small claims. Despite the venue clause above, either party may bring an individual claim in a small-claims court (or a similar simplified procedure for small claims) that has jurisdiction, if the claim qualifies.
Consumers outside Puerto Rico. If you're a consumer, nothing in this section takes away mandatory protections of the laws of the place where you live, or your right to bring a claim in your local courts where the law gives you that right.
17. General
These Terms (with the policies they link to) are the whole agreement between you and us about the Service.
If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver.
You can't transfer these Terms without our consent; we may transfer them as part of a merger, sale, or reorganization, with notice to you.
We're not responsible for delays caused by events beyond our reasonable control.
Language. These Terms are available in English and Spanish. If there is any conflict, the English version controls, except where the law requires otherwise.
